These Sales Terms and Conditions apply to all quotations, offers, and contracts for the sale of forklifts, attachments, used equipment, and parts by COMPASS FORKLIFTS PTY LTD (“Compass Forklifts”).
Unless otherwise stated in writing, all quotations are valid for 30 days from the date of issue. Compass Forklifts reserves the right to withdraw or amend a quotation at any time prior to written acceptance.
All equipment is offered subject to prior sale. A quotation does not reserve a specific unit or “hold” stock. Availability is only confirmed upon receipt of a signed Sales Order and/or a required deposit.
While we strive for accuracy, all technical specifications (lift heights, capacities, turning circles, etc.) are based on manufacturer data and standard configurations. Compass Forklifts reserves the right to make minor modifications to specifications or models supplied, provided they do not materially affect the performance or purpose of the equipment.
Customer Responsibility: It is the customer’s sole responsibility to ensure the equipment is suitable for their specific site, including floor loading limits, doorway clearances, racking widths, and ventilation.
Any delivery dates provided are estimates only. Compass Forklifts is not liable for any loss, damage, or “down-time” costs resulting from delays in delivery caused by shipping, customs, factory production, or third-party logistics.
The customer must inspect the equipment immediately upon delivery or collection. Any visible damage or discrepancies must be noted on the delivery document. The equipment is deemed accepted in good condition unless written notice of a defect is provided to Compass Forklifts within 48 hours of delivery.
Unless credit terms have been approved in writing, payment in full is required prior to the dispatch of equipment. For specialized orders, a non-refundable deposit may be required.
Nothing in these terms excludes, restricts, or modifies any guarantees or rights you have under the Australian Consumer Law (ACL). For business-to-business transactions where the ACL allows, our liability for a breach of a guarantee is limited to the repair or replacement of the goods or the cost of having the goods repaired.
To the extent permitted by law, Compass Forklifts shall not be liable for any indirect, incidental, or consequential loss (including loss of profit or business interruption) arising out of the sale or use of the equipment.
